On May 17, 2024, Colorado Governor Jared Polis signed into law the Colorado Artificial Intelligence (AI) Act, making Colorado the first U.S. state to enact comprehensive legislation regulating the use and development of AI systems. The law aims to protect against algorithmic discrimination arising from high-risk AI systems. Employers using AI systems will be subject to the law, with different requirements and rules depending on whether they are developers or deployers. Colorado has its own definition of algorithmic discrimination, and the law focuses on high-risk AI systems that make consequential decisions, including those related to employment. Deployers/employers are required to use reasonable care to protect consumers from algorithmic discrimination and may have affirmative defenses if they discover and cure violations. Several other states are also considering similar AI legislation and regulations.
